Event terms and conditions Mobile Locker Adria

1. Applicability‍

1.1.
These General Terms and Conditions apply to the use of lockers provided by Mobile Locker Adria and located at a festival or event for storage of items or charging devices by the user in the lockers operated by Mobile Locker Adria.

1.2. All agreements concluded by Mobile Locker Adria are exclusively governed by Croatian law. Disputes arising from an agreement to which these terms and conditions apply shall be adjudicated by the competent court, provided that the counterparty is granted a period of one month after Mobile Locker Adria has invoked this provision in writing to choose the competent court according to the law.

2. Offer and acceptance of baggage‍

2.1.
Upon request, the contents of the items must be shown. Mobile Locker Adria is authorized to refuse the offered items without giving reasons. Mobile Locker Adria is authorized to refuse the offered items without giving reasons.

2.2. Items with a value exceeding 500 euros may not be stored in a single locker.

2.3. If, however, valuables or baggage with a value exceeding 500 euros are placed in a locker, the agreement shall be deemed not to cover those valuables, or it shall be deemed to apply only to those goods collectively representing a value of 500 euros. The storage of baggage with a higher value than 500 euros is at the risk of the counterparty.

3. Formation of the agreement‍

3.1.
The agreements concerning the provision of lockers are concluded as soon as the counterparty has obtained actual possession of a locker in accordance with the prescribed procedure for that locker.

3.2. Deviating agreements with and/or commitments made by Mobile Locker Adria staff shall only be binding on Mobile Locker Adria if and to the extent that these agreements have been confirmed in writing by Mobile Locker Adria.

4. Inspection, destruction, and removal of baggage‍

4.1.
If the baggage is stored in a locker provided by Mobile Locker Adria, an employee of Mobile Locker Adria is authorized to open that locker and inspect its contents, even if the baggage has been entrusted to Mobile Locker Adria in a closed suitcase, box, or similar container.

4.2. Baggage deemed dangerous or likely to cause inconvenience by Mobile Locker Adria, such as drugs, explosives, chemicals, perishable goods, living beings, etc., may be destroyed or removed by Mobile Locker Adria at the counterparty’s expense, without the counterparty being able to make any claim in this regard.

5. Use of the locker‍

5.1.
The baggage must be collected during the specified opening hours of an event or festival. Festival x camping: The baggage must be collected during the specified rental period. After the rental period has expired, an hourly surcharge will be applied. The lockers will only be opened once the due fees have been fully paid.

5.2. Once the rental period has expired, Mobile Locker Adria is authorized to store the baggage elsewhere. The items will be bagged, documented and stored at Mobile Locker Adria or by the event or festival organization.

5.3. Any form of food or open beverages is prohibited from being stored in the locker. In the event that Mobile Locker Adria encounters food or open beverages, Mobile Locker Adria reserves the right to remove and dispose of these items without the intervention of the owner.

5.4. Lockers with electrical outlets are exclusively for charging purposes. The use of electrical devices such as flat irons, hairdryers, power strips, kettles, etc., is strictly prohibited. Any violation of this policy will result in the removal of the locker contents and termination of the rental by Mobile Locker Adria.

5.5. If a total of 6 weeks have passed without the baggage being collected, the counterparty has relinquished their right to it. Mobile Locker Adria is then entitled to sell or destroy this baggage, without the counterparty being able to make any claim in the case of destruction. If the items need to be sent, the rental price, administrative fee of €25 + shipping costs must be settled in advance.

6. Liability

6.1.
Mobile Locker Adria is only liable for damage to or loss of items in a locker to the extent that such damage or loss is attributable to the malfunctioning of that locker and to the extent that this damage and loss are not covered and compensated by an insurance policy taken out by the counterparty. A locker is deemed to malfunction only if it does not work in accordance with the specifications applicable to the locker. The counterparty must verify before using a locker that it is empty and clean and that all parts of the locker are functioning properly. Upon closing the locker, the user must ensure that the locker door is securely locked.

6.2. If Mobile Locker Adria is liable, this liability is at all times limited to an amount of 500.00 € (including VAT) per locker.

6.3. If the counterparty’s baggage causes damage attributable to Mobile Locker Adria or to the baggage of third parties, the counterparty must compensate Mobile Locker Adria for such damage.

7. Reporting damages and settlement of damages‍

7.1.
In the event of damage or loss, the counterparty must immediately inform the designated Mobile Locker Adria staff member via a dedicated email address, displayed at the locker containers or help@mobilelocker.eu. In case of suspected theft, a report must also be made immediately to the local police. Furthermore, the counterparty must notify Mobile Locker Adria in writing of such damages within 48 hours of their discovery, indicating the circumstances under which the damage occurred and sending a copy of any report made to the police.

7.2. The amount of the damage compensation will be paid by Mobile Locker Adria within four weeks after the final determination of our liability and the amount of the damage compensation. If missing goods are found and reclaimed, the counterparty is obliged to take back these goods and repay any previously paid compensation for damages.

8. Use data of lockers‍

For the determination of facts relating to the use of lockers, unless proven otherwise, the data stored or indicated in the registration system for the respective locker are decisive. This data may be requested by the other party and is stored exclusively for this purpose.

9. Pre-sales‍

9.1.
If lockers are offered online in advance, a reservation can be canceled up to a maximum of 10 business days before the festival or event. Any requests for the cancellation of a reservation after this period has passed shall be declined at the discretion of Mobile Locker Adria.

9.2. The purchaser of a reservation is responsible for selecting the correct event, locker zone and/or location when making the booking. In the event that a locker is purchased incorrectly, Mobile Locker Adria is not obligated to modify or refund the reservation.

9.3. In the event that a person with a reservation is unable to collect their locker due to personal errors or circumstances, such as illness or changes in personal plans, Mobile Locker Adria is not obligated to issue a refund.

10. Force majeure‍

If a locker cannot be used due to circumstances beyond the user’s control, such as storms, event cancellation, or other unforeseen situations, Mobile Locker Adria is not obligated to provide a full refund. Each case will be assessed individually, and a suitable solution may be offered, such as a voucher or partial refund.

Opće odredbe Mobile Locker Adria

1. Primjenjivost

1.1.
Ovi Opći uvjeti primjenjuju se na korištenje ormarića koje pruža Mobile Locker Adria i koji se nalaze na festivalu ili događanju za pohranu predmeta ili punjenje uređaja od strane korisnika u ormarićima kojima upravlja Mobile Locker Adria.

1.2. Na sve ugovore koje sklapa Mobile Locker Adria primjenjuje se isključivo hrvatsko pravo. Sporovi koji proizlaze iz ugovora na koji se primjenjuju ovi uvjeti rješavaju se pred nadležnim sudom, pod uvjetom da se drugoj ugovornoj strani ostavi rok od mjesec dana nakon što Mobile Locker Adria pisanim putem pozove na ovu odredbu da odabere nadležni sud u skladu sa zakonom.

2. Ponuda i prihvat predmeta

2.1.
Na zahtjev, sadržaj predmeta mora biti pokazan. Mobile Locker Adria ima pravo odbiti ponuđene predmete bez navođenja razloga.

2.2. Predmeti čija vrijednost prelazi 500 eura ne smiju se pohranjivati u ormarić.

2.3. Ako se ipak u ormarić pohrane dragocjenosti ili prtljaga vrijednosti veće od 500 eura, smatra se da ugovor ne obuhvaća te dragocjenosti ili se smatra da se odnosi samo na robu ukupne vrijednosti do 500 eura. Pohrana predmeta veće vrijednosti od 500 eura je na rizik druge ugovorne strane.

3. Sklapanje ugovora

3.1.
Ugovori o korištenju ormarića sklapaju se čim druga ugovorna strana stvarno preuzme ormarić u skladu s propisanim postupkom za taj ormarić.

3.2. Odstupajući dogovori i/ili obveze koje daju zaposlenici Mobile Locker Adria obvezuju Mobile Locker Adria samo ako su i u mjeri u kojoj su potvrđeni pisanim putem od strane Mobile Locker Adria.

4. Pregled, uništenje i uklanjanje predmeta

4.1.
Ako su pohranjeni predmeti u ormariću koji pruža Mobile Locker Adria, zaposlenik Mobile Locker Adria ima pravo otvoriti taj ormarić i pregledati njegov sadržaj, čak i ako su predani u zatvorenom kovčegu, kutiji ili sličnom spremniku.

4.2. Predmeti koji se smatraju opasnim ili koja može uzrokovati neugodnosti prema procjeni Mobile Locker Adria, poput droga, eksploziva, kemikalija, kvarljive robe, živih bića itd., može biti uništena ili uklonjena o trošku druge ugovorne strane, bez prava na bilo kakvu naknadu.

5. Korištenje ormarića

5.1.
Predmeti se moraju preuzeti tijekom naznačenog radnog vremena događanja ili festivala. Festival x kampiranje: prtljaga se mora preuzeti tijekom definiranog razdoblja najma. Nakon isteka razdoblja najma naplaćuje se dodatna naknada po satu. Ormarići će se otvoriti tek nakon što su sve naknade u potpunosti podmirene.

5.2. Nakon isteka razdoblja najma, Mobile Locker Adria ima pravo premjestiti prtljagu na drugo mjesto. Predmeti će biti zapakirani, dokumentirani i pohranjeni kod Mobile Locker Adria ili kod organizatora događanja ili festivala.

5.3. Zabranjeno je pohranjivati bilo kakvu hranu ili otvorena pića u ormarić. Ako Mobile Locker Adria pronađe takve predmete, zadržava pravo ukloniti i zbrinuti ih bez sudjelovanja vlasnika.

5.4. Ormarići s električnim priključcima namijenjeni su isključivo za punjenje. Korištenje električnih uređaja poput pegli za kosu, sušila za kosu, produžnih kabela, kuhala itd. strogo je zabranjeno. Svako kršenje ovog pravila rezultirat će uklanjanjem sadržaja ormarića i raskidom najma od strane Mobile Locker Adria.

5.5. Ako prođe ukupno 6 tjedana bez preuzimanja prtljage, druga ugovorna strana gubi pravo na nju. Mobile Locker Adria tada ima pravo prodati ili uništiti prtljagu, bez prava na naknadu. Ako je potrebno slanje predmeta, cijena najma, administrativna naknada od 25 € + troškovi dostave moraju se unaprijed podmiriti.

6. Odgovornost

6.1.
Mobile Locker Adria odgovara za štetu ili gubitak predmeta u ormariću samo u mjeri u kojoj su takva šteta ili gubitak posljedica neispravnosti ormarića i ako ta šteta nije pokrivena osiguranjem druge ugovorne strane. Smatra se da je ormarić neispravan samo ako ne radi u skladu sa specifikacijama. Korisnik je dužan prije korištenja provjeriti da je ormarić prazan, čist i ispravan te da su svi dijelovi funkcionalni. Prilikom zatvaranja, korisnik mora osigurati da su vrata ormarića pravilno zaključana.

6.2. Ako Mobile Locker Adria odgovara, ta odgovornost je uvijek ograničena na iznos od 500,00 € (s PDV-om) po ormariću.

6.3. Ako prtljaga druge ugovorne strane uzrokuje štetu Mobile Locker Adria ili prtljazi trećih osoba, druga ugovorna strana dužna je nadoknaditi nastalu štetu.

7. Prijava i naknada štete

7.1.
U slučaju štete ili gubitka, druga ugovorna strana mora odmah obavijestiti ovlaštenog zaposlenika Mobile Locker Adria putem posebne e-mail adrese istaknute na ormarićima ili putem info@mobilelocker.hr. U slučaju sumnje na krađu, potrebno je odmah obavijestiti i lokalnu policiju. Također, potrebno je pisanim putem obavijestiti Mobile Locker Adria u roku od 48 sati od saznanja za štetu, uz opis okolnosti i dostavu kopije policijskog zapisnika.

7.2. Naknada štete bit će isplaćena od strane Mobile Locker Adria u roku od četiri tjedna nakon konačnog utvrđivanja odgovornosti i iznosa štete. Ako se izgubljeni predmeti pronađu, druga ugovorna strana dužna ih je preuzeti i vratiti prethodno isplaćenu naknadu.

8. Podaci o korištenju ormarića

Za utvrđivanje činjenica vezanih uz korištenje ormarića, odlučujući su podaci pohranjeni u sustavu registracije za odgovarajući ormarić, osim ako se ne dokaže suprotno. Ti podaci mogu se zatražiti od druge strane i pohranjuju se isključivo u tu svrhu.

9. Pretprodaja

9.1.
Ako su ormarići unaprijed ponuđeni online, rezervacija se može otkazati najkasnije 10 radnih dana prije festivala ili događanja. Nakon tog roka, zahtjevi za otkazivanje mogu biti odbijeni prema procjeni Mobile Locker Adria.

9.2. Kupac je odgovoran za odabir ispravnog događanja, zone ormarića i/ili lokacije prilikom rezervacije. Ako je rezervacija pogrešno napravljena, Mobile Locker Adria nije obvezan izmijeniti ili refundirati rezervaciju.

9.3. Ako osoba s rezervacijom ne može preuzeti ormarić zbog osobnih razloga (bolest, promjena planova itd.), Mobile Locker Adria nije obvezan izvršiti povrat novca.

10. Viša sila

Ako se ormarić ne može koristiti zbog okolnosti izvan kontrole korisnika, poput oluja, otkazivanja događanja ili drugih nepredviđenih situacija, Mobile Locker Adria nije obvezan izvršiti puni povrat. Svaki slučaj razmatra se pojedinačno te se može ponuditi odgovarajuće rješenje, poput vaučera ili djelomičnog povrata.
